====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 04-06-2020 Heard Ms. Kumari Sudha Sinha, learned counsel for the petitioner, and Mr. Raj Ballabh Singh, the learned A.P.P. for the State, through Video Conferencing.

The petitioner seeks bail in connection with Bhargama P.S. Case No.103 of 2015 registered under Sections 323, 307 and 393 of the Indian Penal Code besides Section 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that on the basis of the fardbeyan of the informant Md. Sunni, the present case was instituted on 24.05.2015 against unknown. In course of investigation, the petitioner was apprehended by the police in Bharrahi (Madhpura) P.S. Case No.671 of 2015 and the police

Patna High Court CR. MISC. No.15991 of 2020(2) dt.04-06-2020 2/2 got managed to record the confessional statement of the petitioner showing his involvement in the present case. Further submission is that while the petitioner is accused in five other cases, as detailed in paragraph-3 to this application, but in all those cases, he is on bail. The petitioner, in the present case, is in custody since 21.06.2017.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Bhargama P.S. Case No.103 of 2015. Out of the two sureties, one must be either parents or the close relative of the petitioner.
