The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 342, 323, 449, 307, 379 of the Indian Penal Code, 27 of the Arms Act and 4 and 5 of the Explosive Substances Act.
It is specifically alleged that co-accused Anandi Yadav, Mathura Yadav and petitioner Bhikhari Yadav threw explosive, causing injuries to the wife, son and daughter of the informant. The accused persons also took away house hold articles and cash Rs. 8000/-. It is submitted by the learned counsel for the petitioners that specific accusation of throwing explosive is against petitioner no.
Patna High Court Cr.Misc. No.10725 of 2015 (2) dt.17-03-2015 1, whereas injury report suggests that neither the informant's wife, son nor daughter received any explosive injury. The injuries of the injured persons have been found to be simple in nature caused by hard and blunt substance.
Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura in connection with Sheikhpura P.S. Case No. 461 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
