ANJANA MISHRA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Kahalgaon PS case no. 360/2015 for allegedly having committed the offence under Sections 147, 148, 149, 337, 427, 379, 504 of the Indian Penal Code and Section 27 of Arms Act.
Learned counsel for the petitioners submit that the petitioners are facing prosecution in retaliation to Kahalgaon PS case no. 357/2015 which has been lodged by the present petitioners against one Arbind Singh. It is submitted that there is general and omnibus allegation against the petitioners. There is no
Patna High Court Cr.Misc. No.10160 of 2016 (2) dt.03-05-2016 2/2 specific allegation against them.
Considering the aforementioned facts and circumstances, the nature of allegation and that the petitioners have got no criminal antecedents, let the petitioner, abovenamed, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Bhagalpur in connection with Kahalgaon PS case no. 360/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
