JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 26-02-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Danapur P.S. Case No. 639 of 2018 for the offence under Sections 399, 402, 414 of the Indian Penal Code and Sections 25(1-b)a, 26/35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He submits that in the instant case allegation is that one stolen Pulsar Motorcycle was seized from the house of this petitioner and he was among the people, who assembled in preparation of committing dacoity. He further submits that the petitioner is in custody since 16.09.2018 and as such he has remained in custody for more than five months.
