The petitioner is languishing in custody since 04.12.2018 in a case registered for the offence punishable under Section 379 of the Indian Penal Code.

The prosecution case is that from the shop of the informant, theft of Rs.95,000/- was committed and subsequently, from the CCTV footage, the petitioner was identified.

It is submitted by learned counsel for the petitioner that there is no recovery from the conscious physical possession of the petitioner and investigation has already been concluded. A statement has been made in paragraph no. 3 of the petition that the petitioner is not having any criminal antecedent.

Considering the fact that investigation has already being concluded, coupled with statement made in paragraph no. 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Bettiah, West Champaran in connection with Chanpatiya P.S. Case No.489 of 2018 .
