Petitioners in the present case are seeking anticipatory bail in connection with Masaurhi P.S. Case No. 619 of 2018 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 325, 307, 337, 338, 332, 353, 153A, 427 of the Indian Penal Code, Section 27 of Arms Act and 3/4 of Damage of Public Property Act.

Patna High Court CR. MISC. No.25005 of 2019(3) dt.25-07-2019 2/3 Learned counsel for the petitioner submits that in this case FIR has been lodged alleging that some persons were trying to give religious colour to attack on one Suraj Pandit of Kumhar Toli. The petitioner is said to be a member of the mob. Learned counsel submits that there are 250-300 people against whom general and omnibus allegations have been made and some of them have granted privilege of anticipatory bail by learned Co-ordinate Bench of this Court in Criminal Miscellaneous No. 15641 of 2019, Criminal Miscellaneous No. 22873 of 2019 and Criminal Miscellaneous No. 24839 of 2019. Learned APP for the State is present and confirms the factual position saying that this petitioner was a member of the mob and there is no specific allegation of assault against these petitioners.

In the given facts and circumstances of the case, where the petitioners are said to be members of the mob but there is no allegation of causing of assault against them, Let the petitioners above named, in case of their arrest or surrender within four weeks from today in connection with Masaurhi P.S. Case No. 619 of 2018, be released on bail on execution of bail bonds of Rs. 15,000/- (fifteen thousand) each with two sureties of the like amount each to the satisfaction of
