The petitioners seek anticipatory bail in Barharia P.S. Case No.542 of 2014 instituted for the offences under Sections 304(B)/34 of the Indian Penal Code.

Petitioners are father-in-law and mother-in-law. Allegation has been made to have strangulated the victim by her husband, mother-in-law, father-in-law and sister-in-law on account of not satisfying the demand of dowry. So much so there is allegation of torture and misbehaviour with the victim lady.

Learned counsel for the petitioners submits that it was a natural conduct of the petitioners that they themselves

Patna High Court Cr.Misc. No.9673 of 2015 (6) dt.30-07-2015 informed the police and police on their information reached to the place of occurrence which itself shows them innocent. In the present case, case diary was called for. Looking to the statements recorded in the case diary and looking to the nature of the case, this Court is not inclined to enlarge the petitioners on anticipatory bail. Accordingly the prayer for bail is rejected. However, this order will not prejudice the court below in considering the case of the petitioners.
