2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 8(b), 18, 29 of the N.D.P.S. Act.

3. It is a case of illegally cultivation of opium in forest land by the petitioner along with others. Villagers saw the petitioner fleeing away from the forest land.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case on the disclosure of local people. Neither the petitioner was arrested on spot nor any incriminating article has been recovered from his conscious

Patna High Court CR. MISC. No.20524 of 2024(3) dt.26-04-2024 2/2 possession. It is further submitted that the petitioner is languishing in judicial custody since 12.10.2023. Similarly situated co-accused Arjun Singh has already been enlarged on bail by this Court vide order dt. 13.10.2023 passed in Cr. Misc. No. 65540 of 2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Barachatti P.S. Case No. 1135 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge N.D.P.S. Act, Gaya.
