The petitioner apprehends his arrest in Bhabua P.S. Case No. 651 of 2015 registered for the offences punishable under Sections 420, 406, 422 and 423 of the Indian Penal Code. The gist of the allegation is that the petitioner took Rs. 3,00,000/- from the informant for getting the sale deed executed with regard to a piece of land of Mukhram Kahar, but the petitioner neither returned the money nor got the sale deed executed.

Learned counsel for the petitioner submits that the petitioner is ready to return the entire amount for which he had issued chueque. The petitioner has also paid Rs. 25,000/- to the informant and he is willing to pay the remaining amount of Rs.

Patna High Court Cr.Misc. No.9865 of 2016 (5) dt.19-07-2016 2/2 2,75,000/- within one and half months.

Learned counsel appearing on behalf of the informant did not raise any objection.

Considering the facts aforesaid and the fact if the petitioner returns the entire amount through draft within six weeks, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhabua in Bhabua P.S. Case No. 651 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
