Petitioner seeks bail in a case registered for the offences punishable under Sections 363 and 366(A)/34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping of the minor daughter of the informant.

The statement of the victim-girl before the Mahila Police Station as well as her statement under Section 164 Cr.P.C. would reveal that she had traveled with the petitioner at different places and nowhere she made any protest and on that basis submission of the petitioner is that the matter is of love affairs.

Considering the aforesaid facts, let the petitioner,

Patna High Court Cr.Misc. No.24080 of 2017 (3) dt.20-06-2017 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Judge (POSCO) Purnea/successor Court in connection with Special Case No. 12 of 2017 arising out of Sadar Police Station Case No. 321 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
