JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2019 This is an application for grant of anticipatory bail in connection with Banka P.S. Case No. 817 of 2018, disclosing offences under Sections 457 and 380 of the Indian Penal Code. Allegation is of theft in the house of the informant and the informant suspected the hand of the petitioner as he was making enquiry in the evening from his grandson and granddaughter.

Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case only on the basis of suspicion and he has no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court
