2. The petitioners have preferred this application for grant of regular bail in connection with Bakhtiarpur P.S. Case No. 483 of 2023 dated 07.11.2023 registered for the offences punishable under sections 341, 323, 307, 504, 506, 34 of the Indian Penal Code and sections 25(1-B)a, 26, 27 of the Arms Act.

3. As per the prosecution case, the informant was going to his house meanwhile petitioners along with the other

Patna High Court CR. MISC. No.17649 of 2024(3) dt.26-06-2024 2/3 co-accused persons are alleged to have caught hold of the informant and petitioner no. 3 opened fire on the informant. The petitioner no. 2 hit the informant with bricks and the petitioner no. 3 opened fire which hit the face and neck of the informant.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioners. There is case and counter case between both the parties. The injury sustained by the informant is found to be simple in nature as stated in para 9 of the bail petition. The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in judicial custody since 07.11.2023.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioners.

6. Considering the aforesaid facts and circumstances of the case as well as the period of their custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Barh, in connection with Bakhtiarpur P.S. Case No. 483 of 2023.
