JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-03-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 307/34,341,323,324 and 325 of the Indian Penal Code. It is alleged that petitioners Laxman Rai and Diwakar assaulted Sanjay Kumar Singh on head whereas petitioners Arvind Rai and Sitaram Rai assaulted Bindeshwari Singh and Dhirendra Kumar Gautam.
It is submitted by the learned counsel for the petitioners that all the injured persons received only one injury whereas it is alleged that each injured were assaulted by more than one accused
Patna High Court Cr.Misc. No.10972 of 2015 (2) dt.17-03-2015 2/2 and opinion with regard to the injury of Sanjay Kumar has been kept reserved. It is further submitted that there is counter version of the occurrence also and the accusation has been levelled in the background of land dispute.
It is submitted by learned counsel for the informant that the opinion with regard to injury of Sanjay Kumar has been reserved and he is still under treatment.
Considering the nature of accusation and the fact that the injury reports are not corroborative with the accusation, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Rohtas at Sasaram in connection with Kochas P.S. Case No. 116 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Anil/- U T
