The petitioner apprehends his arrest in connection with Hathauri P.S. Case No. 230 of 2019 for the offence under Sections 272, 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.
In the instant case two bottles liquor containing 180 ml was seized.
Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that the petitioner has been roped in this case as his motorcycle was parked near the place where the liquor was seized. Considering the fact that the petitioner has got no criminal antecedent and nothing was recovered from the house or conscious possession of the petitioner, the petitioner named above, in the event of arrest or surrender before the court below
Patna High Court CR. MISC. No.11530 of 2020(2) dt.04-03-2020 2/2 within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Muzaffarpur in connection with Hathauri P.S. Case No. 230 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
