He is permitted to do so.
Heard learned counsel for the petitioner and learned A.P.P. for the State.
Let the defect (s), as pointed out by the office, be removed within a period of four weeks from today. The petitioner seeks bail in connection with a case registered for the offences punishable under Section 392/34 of the Indian Penal Code.
Allegation is of robbery of Rs. 6,40,963/- from North Bihar Gramin Bank, Rauta Branch and snatching of mobile from the Branch Manager, namely, Shakti Kumar (informant).
Patna High Court CR. MISC. No.13204 of 2022(3) dt.21-09-2022 2/3 Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that First Information Report was lodged against four unknown persons and during the course of investigation, one, Gautam Kumar confessed the guilt before the police and he disclosed the name of the petitioner. Further, it is submitted that the main accused Gautam Kumar has been granted bail on 10.02.2022 by learned Court of Additional District and Sessions Judge-1st, Madhepura in Bail Petition No. 54 of 2022 (Annexure-2). Learned counsel for the petitioner further submits that the petitioner was working in the said bank and at the time of occurrence, he resisted the persons who forcefully entered in the bank.
It is stated that the police and bank never took the pain to match the denominations of the notes amounting Rs. 55,510/- recovered from the house of the petitioner to the cash looted from the bank. Further, it is submitted that the cash which was recovered belongs to his personal assets and it has no relation with looted amount. Petitioner is in custody since 04.12.2021, charge-sheet has been submitted in this case and is a person with clean antecedent. Learned A.P.P. for the State opposes the prayer for regular bail of the petitioner.

No.13204 of 2022(3) dt.21-09-2022 3/3 Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) only with two sureties of the like amount each to the satisfaction of the learned ACJM-IV, Madhepura in connection with Kumarkhand P.S. case No. 331 of 2021.
