It is not that he has been appointed on merit or by following Articles 14 and 16 of the Constitution of India. He cannot beget or bargain after being offered the position and opening that on the ground that what was offered is not acceptable to him in terms of service or pay. It is open to him to opt out or go out in the open and compete to reach a position of his liking. This Court cannot show more compassion within compassion.
