The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 419, 420, 406, 504 and 506/34 of the Indian Penal Code. The prosecution case got initiated with the written report dated 06.10.2017 to the effect that on 12.02.2013 the petitioner and her husband executed an agreement to sell the land in favour of the informant and received Rs. One lakh as advance. Subsequently, Rs.1,47,000/- was also given to the petitioner and her husband by the informant, but the sale deed was not executed.

It is submitted by learned counsel for the

Patna High Court Cr.Misc. No.9576 of 2018 (2) dt.17-02-2018 petitioner that the period of agreement to sell got expired on 12.07.2013 when the FIR was registered on 06.10.2017. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Considering the fact that the accusation arising out of contractual nature of dispute and the FIR has been lodged with inordinate delay, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Patna City in connection with Agamkuan P.S. Case No. 496 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
