Petitioner seeks bail in a case registered for the offences punishable under Sections 328, 302, 120B/34 of the Indian Penal Code.

The suspicion is against co-accused Ashok Singh and his wife that they administered poison to the husband of the informant.

Allegation against the petitioner is that he was also along with Jyoti Shankar Prasad, when Jyoti Shankar Prasad asked the husband of the informant to go to the house of Ashok Singh. Jyoti Shankar Prasad was Manager of Ashok Singh. The case diary would reveal that there is no other direct material against the petitioner.

Learned counsel for the informant opposed the prayer

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Parwalpur Police Station Case No. 124 of 2018, with the following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.

(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Rajan/Banti U T
