The petitioner seeks bail in connection with Mahua P.S. Case No.303/2016 registered under Sections 272, 273 of Indian Penal Code and Sections 47(A) of Bihar Prohibition and Excise Act, 2016.

21 liters of foreign liquor is said to have been recovered from the hut of the petitioner.

It is submitted by learned counsel for the petitioner that the hut from where liquor is said to have been recovered does not belong to the petitioner. No incriminating article has been recovered from the conscious physical possession of the petitioner. The petitioner has been falsely implicated in this case. He has no

Patna High Court Cr.Misc. No.7881 of 2018 (2) dt.13-02-2018 2/2 concern with the seized liquor. The petitioner has got no criminal antecedent. He has been languishing in custody since 01.12.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Vaishali at Hajipur, in connection with Mahua P.S. Case No.303/2016.
