2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 307, 337, 504 of the Indian Penal Code and section 27 of the Arms Act.

3. As per the prosecution case, all the FIR named accused persons including these petitioners pelted stones and bricks on the informant side and also resorted to firing.

4. It is submitted on behalf of the petitioners that as a matter of fact quarrel took place between the parties over

Patna High Court CR. MISC. No.21257 of 2024(2) dt.04-04-2024 2/2 dispute of drainage water. Allegation of assault is general and omnibus and no specific overt act has been alleged against these petitioners. Though, there is allegation of filing, but nobody sustained fire arms injuries. Petitioners claim clean antecedent.

5. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate Nalanda in Rahui (Bhagan Bigha) P.S. Case No. 163 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
