The petitioner seeks bail in Fatehpur P.S. Case No. 63 of 2017 instituted for the offence under Section(s) 411 and 414 of the Indian Penal Code.
It has been submitted that the petitioner has clean antecedent.
As per the written report, one motor-cycle bearing Registration no. JH10F-9264, was recovered from the possession of the petitioner by the Police and the petitioner could not produce any paper of the said vehicle.
The counsel for the petitioner submits that no any complaint for theft of the said motor-cycle was ever made by anybody. The D.T.O. Dhanbad reported that the vehicle recovered
Patna High Court Cr.Misc. No.24187 of 2017 (2) dt.22-05-2017 2/2 from the possession of the petitioner belongs to one Jai Nath Bhuiyan of Jharkhand.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of like amount each to the satisfaction of the Additional Chief Judicial Magistrate-X, Gaya in connection with Fatehpur P.S.
