Mr.Rajesh Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 15-05-2025 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State.

2. The petitioner is seeking regular bail in connection with Sirisiya P.S. Case No. 102 of 2024, registered for the offences punishable under Sections 20(b)(ii)(c)/29 of the NDPS Act. 1985.

3. Allegedly, 2.538 kg of charas was recovered from the possession of co-accused Dilip Kumar. He disclosed that the petitioner had given him that charas to deliver in Ludhiana.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that nothing was recovered from the possession of the petitioner and she is a lady of clean antecedents. She is incarcenating along with her two-year-old child since 20.12.2024.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. The petitioner was arrested at the spot and no incriminating article has been recovered from her possession. She is a lady of clean antecedent.

7. Considering the above-mentioned facts and circumstances, let the petitioner above-named, is directed to furnish bail bond and on doing so, the court below shall release the petitioner on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Exclusive Court of NDPS Act, Bettiah, West Champaran in connection with Sirisiya P.S. Case No. 102 of 2024, subject to the following conditions that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

8. Before accepting the bail bond, the learned court below shall verify the criminal antecedent of the petitioner and if she is found involved in any case except the present one, her bail bond shall not be accepted.
