The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 326, 307, 353, 504/34 of the Indian Penal Code. Prosecution case is that the informant being RPF personnel was on duty on 29.11.2015 at Kaparpura railway station, he found six persons standing on suspicious condition near Rear SLR between line no.4 and 5 when the informant flashed light on them they started assaulting the informant and tore the uniform of the informant. The informant identified only Pintu Singh. The name of the petitioner sprang up during investigation.

Patna High Court Cr.Misc. No.9197 of 2016 (2) dt.29-02-2016 2/2 It is submitted by learned counsel for the petitioners that only on suspicion the accusation has been levelled. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent and the informant has received only simple injury. The impugned order also reflects suspicious nature of accusation against the petitioners. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Sonepur, Saran at Chapra in connection with Muzaffarpur Rail P.S. Case No.70/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.

However, learned court below will be at liberty to cancel the bail bonds of the petitioners, if they default for two consecutive occasions.
