The petitioner seeks regular bail in connection with Ujiarpur PS case no. 161 of 2018 registered for the offence punishable under Sections 414 of Indian Penal Code and 25(1-B)A, 26, 35 of Arms Act.

The allegation is regarding the petitioner having been apprehended by the police and one countrymade loaded pistol along with one mobile phone is said to have been recovered from the petitioner herein.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and is languishing in custody since 15.07.2018 i.e. since more than 07 months. It is further submitted that though the petitioner is

Patna High Court CR. MISC. No.12220 of 2019(2) dt.27-02-2019 2/2 accused in four other cases but he has been acquitted in one case and he is on bail in the two cases.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Dalsingsarai, Samastipur in connection with Ujiarpur PS case no. 161 of 2018.
