Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

According to Renu Devi, the eye-witness of the occurrence, three persons assaulted to the mother of the informant with different weapons causing her death.

The Doctor has found single injury on the person of the deceased which was on the head.

Submission of the petitioner is that it is difficult to attribute as to which of the three accused had caused the single head injury. In fact, Renu Devi is not an eye-witness of the occurrence. The petitioner has got no criminal antecedent.

No.24100 of 2017 (3) dt.20-06-2017 2/2 Considering the general and omnibus nature of allegation against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional Sessions Judge, Bhagalpur/successor Court in connection with S.Tr. No. 152 of 2017 arising out of Jagdishpur Police Station Case No. 225 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
