JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2019 The petitioner apprehends his arrest in connection with Kuchayakot P.S.Case No. 373 of 2018 registered under Sections 30(a)(b)(c)/38/41(a)(b) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 492.400 litres of illicit liquor from a truck and the driver who was apprehended, has disclosed that the truck is of Puran Singh and he has been given phone number to whom he has to supply the liquor. It is alleged that mobile number is of the petitioner and he was in touch with the accused persons and there is confessional statement of coaccused also. Submission of learned counsel for the petitioner is that he has no criminal antecedent and has been falsely implicated in this case.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to him rather he should surrender within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order.
