Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application, for grant of anticipatory bail, arises out of Singhia P.S. Case No. 18 of 2014, disclosing offence under Section 304(B)/34 of the Indian Penal Code. The petitioner is a lady and the Gotani of the deceased.

Learned Senior counsel appearing on behalf of the petitioner has submitted that father-in-law of the deceased namely Pukar Manjhi has been granted regular bail by this

Patna High Court Cr.Misc. No.10008 of 2016 (4) dt.11-07-2016 2/2 Court vide order dated 14.10.2015 passed in Criminal Miscellaneous No. 41261 of 2015. It has further been submitted that there is no specific allegation against the petitioner to constitute an offence under Section 304(B) of the I.P.C. so far she is concerned.

Considering the above submission, this application is allowed. Let the petitioner, above-named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Rosara, in connection with Singhia P.S. Case No. 18 of 2014, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
