In this case, the petitioner is seeking regular bail in connection with Deodha P.S. Case No. 29 of 2022, registered for the offences punishable under Sections 307/34 of the IPC and section 27 of the Arms Act.

As per allegation, some miscreants attacked the informant when he was returning to his house along with his friend Sudesh Bhandari. They made the informant injured by fire-arms. The informant has stated further that the petitioner Sujeet Yadav had taken a family loan of Rs. 25,000/- from him and he was making evasive denial. The petitioner, on earlier occasion, had abused and threatened him to kill. Learned counsel for the petitioner has submitted that he is innocent. He is a person of clean antecedent and is

The FIR itself shows that the petitioner was known to the informant but in the FIR, he said that he didn't identify the miscreants. His friend Sudesh Bhandari also didn't identify the miscreants. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Madhubani in connection with Deodha P.S. Case No. 29 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
