JUSTICE PARTHA SARTHY ORAL ORDER 08-04-2021 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Karakat P.S. Case no.26 of 2020 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per allegation in the F.I.R., 10,230 litres of IMFL was recovered from the truck in which the petitioner was one of the occupants.

It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 12.11.2020 (Annexure-1) passed in Cr.Misc. no.25750 of 2020 giving liberty to the petitioner to renew his prayer for bail on completing one year in custody. The petitioner

Patna High Court CR. MISC. No.22241 of 2021(2) dt.08-04-2021 2/2 is in custody since 5.2.2020 and has no criminal antecedent. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the liberty given to the petitioner in the earlier order dated 12.11.2020 along with the period in custody, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Karakat P.S. Case no.26 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District and Sessions Judge-cum-Special Judge (Excise), Rohtas at Sasaram.
