On account of petitioner's promotion as Record Keeper from the post of Guard in the Bank, fixation of salary of the petitioner has been done vide Annexure 3 dated 23.7.2002. Disputing the said fixation the petitioner submits that he is entitled to fixation of higher pay of Rs. 7471/-. Respondent Bank, on the other hand, submits that

Patna High Court CWJC No.16514 of 2016(2) dt.27-02-2019 2/2 even the scale granted by communication dated 23.7.2002 (Annexure 4) is excessive as a result of inadvertance in calculation in respect of stagnation increment which has been added in the said communication dated 23.7.2002. The petitioner has never approached the respondents for higher scale as prayed in the instant writ petition. The petitioner would be at liberty to approach the respondent Bank for the relief prayed for.

The writ petition is dismissed.
