JUSTICE SANJAY PRIYA ORAL ORDER 25-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Prosecution Report bearing P.S. Case No. 144 of 2017 instituted for the offence under Section-37(KH) of the Bihar Excise Prohibition Act, 2016. Allegation against the petitioner is that he was found in drunken state and in test from breath analyzer, it was found 304.9mg/100ml positive.

The petitioner is said to be in custody since 05-042017. He has no criminal antecedent. In such circumstances, this petition for bail is allowed and the petitioners named above, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with

Patna High Court Cr.Misc. No.24357 of 2017 (2) dt.25-05-2017 2/2 Prosecution Report bearing P.S. Case No. 144 of 2017 to the satisfaction of learned 4th Additional Sessions Judge-cum-Special Judge, Bhagalpur subject to condition that both the bailors should be close relatives of the petitioner.
