JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 22-05-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Nawada P.S. Case No. 200 of 2017 registered under Sections 147, 148, 149, 341, 323, 307, 353, 188, 283, 337, 153A and 427 of the Indian Penal Code, Section 27 of the Arms Act and Sections 3 and 4 of the Explosive Substance Act.

As per the prosecution case, there was a communal riot. Petitioner happens to be a member of one of the community. He is said to have pelted stone, resorted to firing and exploded bomb.

It is submitted by learned counsel for the petitioner that the allegation levelled against the petitioner is not specific

Patna High Court Cr.Misc. No.24332 of 2017 (2) dt.22-05-2017 2/2 rather general and omnibus in nature. No one has sustained any sort of injury. The petitioner is languishing in custody since 06.04.2017. Other co-accused persons have been enlarged on bail vide Cr. Misc. No. 24018 of 2017 by this Court. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Nawada P.S. Case No. 200 of 2017.
