JUSTICE ARUN KUMAR ORAL ORDER 05-03-2018 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

The petitioner, already in custody, seeks bail in connection with Trial No. 2808 of 2017 arising out of Chhatauni P.S.Case No. 207/2017 registered under Sections 115, 120 (B) of the Indian Penal Code and under Sections 25 (1-A), 25 (1-AA), 25 (1-B)A/ 26 (ii), 35 of the Arms Act.

Allegation in brief is that when unknown criminals were planning to commit murder of a businessman, the police raided the sugar factory and arrested some accused persons including the petitioner with 11 live cartridges of A.H. 47 Gun. Learned counsel for the petitioner submits that the petitioner was not caught at the spot nor anything recovered from the possession of the petitioner and except that the name of the

Patna High Court Cr.Misc. No.12838 of 2018 (2) dt.05-03-2018 2/2 petitioner disclosed by the apprehended accused persons, nothing has been found against the petitioner in this case. The petitioner is in custody since 19.08.2017.

Having considered the said facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand)h with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- VII, Motihari East Champaran in connection with Trial No. 2808 of 2017 arising out of Chhatauni P.S. Case No. 207/2017.
