Petitioner, already in custody, seeks bail in connection with Bettiah Town P.S. Case No.835 of 2017, registered under Sections 363 and 365 of the Indian Penal Code as well as under Section 8 of the POCSO Act.

Allegation in brief is that the daughter of the informant was kidnapped by the accused persons for ransom of Rs.20,00,000/-.

Learned counsel for the petitioner submits that the petitioner is friend of Shubham Gupta with whom the daughter of the informant eloped away and the petitioner is not named in the FIR; whereas the learned counsel for the State submits that

Patna High Court Cr.Misc. No.11891 of 2018(3) dt.09-04-2018 2/2 the statement of the victim girl discloses that this petitioner kidnapped her and played active role in her kidnapping and demanding ransom.

Having considered the nature of offence and the alleged involvement of the petitioner, the prayer of bail of the petitioner is rejected in connection with Bettiah Town P.S. Case No.835 of 2017 pending in the court of learned ADJ, 1st-cumSpecial Judge, Bettiah. (Arun Kumar, J) S.KUMAR/- U T
