The petitioners being parents and sisters of the husband of the informant are apprehending arrest in a case registered for the offences punishable under Sections 498A, 307 of the Indian Penal Code.
Prosecution case is of torture and making attempt to kill the informant by causing burn injuries. Though it is alleged that on the order of petitioner no.1 to cause burn injury, the accused persons caught hold the informant when husband of the informant lit fire.
It is submitted by learned counsel for the petitioners
Patna High Court Cr.Misc. No.9133 of 2016 (2) dt.23-02-2016 2/2 that the thrust of accusation is against the husband of the informant for the same incident Ghorasahan P.S. Case No.65/2015 was also filed wherein on the basis of compromise the husband of the informant was granted regular bail by learned CJM, Bettiah vide order dated 27.11.2015.
Certified copy of the same has been produced by learned counsel for the petitioner. Let it be kept on record. Considering the thrust of accusation against the husband of the informant, who has been granted regular bail, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah, West Champaran in connection with Muffasil P.S. Case No.114/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
