The petitioner has preferred this application for grant of regular bail in a case registered under sections 406, 420, 467, 468 and 34 of the Indian Penal Code.

As per the prosecution case, on a raid being conducted the accused persons were caught and large number of ATM cards etc besides Rs. 12,500/- in cash was recovered from their possession.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case because of his antecedents. Nothing has been recovered from his conscious possession. No witness has supported the case against the petitioner in course of investigation. He is in custody since 10.8.2020 and investigation in the case has concluded.

No.22714 of 2021(4) dt.08-12-2021 2/2 The application for bail is opposed by learned APP for the State who submits that large number ATM cards were recovered from the possession of the petitioner who appears to be a member of a big gang and he has a number of criminal antecedents.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for 1 year 3 months, the Court directs the petitioner to be enlarged on bail in connection with Mufassil P.S. Case no. 292 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya.
