The present petition is for modification of order dated 09.01.2023 whereby the anticipatory bail of the petitioner was rejected with the observation that if the petitioner surrenders before the concerned Court within four weeks, the learned Court shall pass order without being prejudiced by any observation made.

Two months later, modification petition has been filed stating that since he as also his wife were under treatment, he could not surrender. There is no medical certificate to support the said contention and as such the same is fit to be rejected. In the result, the Criminal Misc. no. 20021 of 2023 stands rejected.
