By the impugned order date 06.02.2014, the learned Adhoc Additional District Judge, 1st, West Champaran at Bettiah dismissed the Miscellaneous Appeal No. 04 of 2012 and thereby confirmed the order rejecting the injunction application passed by the trial court on 19.12.2011 in T.S. No. 46 of 2011. 3.
Perused the order passed by the court below. The plaintiffs-petitioners are claiming to be in possession of the property against which they prayed for injunction restraining the
Patna High Court CWJC No.7462 of 2014 (3) dt.22-02-2016 defendants from interfering with their peaceful possession. The defendants filed rejoinder and they claimed that they are in possession of the property. After hearing both the parties and on the basis of the pleadings of the parties, the trial court as well as the appellate court both, concurrently, held that the plaintiffs have got no prima facie case for grant of injunction. 4.
In view of the above factual position, particularly, when both the parties are claiming possession over the property, if injunction is granted in favour of the plaintiffs, it will amount to declaration of possession of the plaintiffs at the stage of injunction itself.

In such view of the matter, I find no reason to interfere with the order passed by the courts below. Thus, this writ application is dismissed.
