Petitioner, already in custody, seeks bail in connection with Athmalgola P.S. Case No.219 of 2017, registered under Sections 302/120(B)/34 of the Indian Penal Code. Allegation in brief is that the husband of the informant was a witness in the case of murder of his son, as a result the accused persons named in the FIR surrounded him in the early morning near Bahurani hotel and Santosh Kumar, Gaurav Kumar, Ranjeet Kumar and Shubham Kumar killed him by shooting indiscriminately.
Learned counsel for the petitioner seeks bail of the petitioner on the ground of parity as other two co-accused, similarly situated, namely, Shyamali Singh @ Shamali Singh
Patna High Court Cr.Misc. No.20360 of 2018(2) dt.06-04-2018 2/2 and Ram Murari Singh have been admitted to bail by coordinate Benches of this Court vide Cr. Misc. Nos.61439 of 2017 and 166 of 2018 on 11.01.2018 and 12.01.2018 respectively. Considering the enmity between both sides and the allegation of firing is not against the petitioner, petitioner Baudhu Singh @ Ram Kumar Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Barh, Patna in connection with Athmalgola P.S. Case No.219 of 2017.
