The present petition has been preferred for quashing of the order dated 05.12.2000 in Complaint Case No. 125 of 2000 arising out of Cr. Case Complaint (P) 0004667 of 2013 passed by learned Additional Chief Judicial Magistrate, Siwan by which the learned Court below took cognizance for the offences under sections 427 and 379 of the Indian Penal Code. As per the allegation, the accused persons demolished the house of the complainant which resulted into death of an ox, she-goat as also hens. The complainant who was also sleeping in the home, however, managed to escape.

Accordingly, the learned A.C.J.M., Siwan took cognizance in the year 2000 which has been challenged in the

Patna High Court CR. MISC. No.10426 of 2016(2) dt.29-03-2023 2/2 year 2016.

The petition is misconceived and is accordingly dismissed.
