This application is for grant of regular bail in connection with Kajra P.S.Case No.45 of 2016 for the offences under Sections 147, 148, 149, 353 and 307 of the Indian Penal Code. Allegation against the petitioner as per F.I.R. is that the police got information that two business traders have been kidnapped and kept in a cave at Lakhisarai and on that information, the police raided at the hill and thereafter two other accused persons were arrested, who have named this petitioner and also sated that kidnapped person is kept in a cave and on that information the police raided there and caught the petitioner there armed with one loaded Pistol and eight cartridges. It is submitted on behalf of the petitioner that so for

Patna High Court Cr.Misc. No.24711 of 2017 (3) dt.28-06-2017 2/2 allegation of kidnapping is concerned for that another case has already been lodged and this case has been filed for the offence under Section 307 of the IPC and the Arms Act. The petitioner is in custody since 27.10.2016.

Heard learned A.P.P. also.

Having heard both sides and in view of serious nature of allegation against the petitioner, the prayer for bail of the petitioner is rejected, however, the learned trial court is directed to expedite the trial and try to conclude it as soon as possible. At the same time, the S.P., Lakhisarrai is directed to ensure attendance of the witnesses so that the trial may be concluded within the period as specified, if possible within a period of one year.

With the aforesaid observation, this application is dismissed.
