1. Heard learned counsel for the petitioner and learned SC-3 Mr. Sunil Kumar Mandal.
2. The learned counsel appearing on behalf of the State at the outset submits that petitioner has rushed to this Court instead of availing his alternative remedy against the order dated 25.11.2024 passed in Mutation Case No.399/20242025 and Mutation Case No.400/2024-2025 by the Circle Officer, Kharik, whereby mutation application of the petitioner stands rejected. The learned State counsel submits that petitioner
Patna High Court CWJC No.4597 of 2025(2) dt.01-07-2025 2/2 has remedy of appeal against the order impugned.
3. At this stage, the learned counsel appearing on behalf of the petitioner seeks permission to withdraw the writ application with liberty to avail his alternative remedy against the order impugned in the instant writ application.
4. Permission is accorded.
5. It is made clear that if any appeal is filed by the petitioner before the authority competent on or before 28.07.2025, the authority competent shall consider and dispose of the appeal within a period of three weeks thereafter, after giving proper opportunity of hearing to the petitioner.
6. It is also made clear that if any issue of limitation arises, the authority competent shall consider that petitioner was availing his remedy before this Court since March, 2025. (Satyavrat Verma, J) amit/- U
