JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2019 Petitioners seek bail in anticipation of their arrest in connection with Phulwaria P.S. Case No. 266 of 2018 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Allegation against the petitioners is that they have assaulted the deceased and thrashed on the ground and one Samarjiya Devi set her on fire.

Submission of learned counsel for the petitioners is that there is general allegation against the petitioners and petitioner No.1 is lady.

Heard learned APP also.

Having heard both sides and in view of allegation, I am not inclined to grant privilege of anticipatory bail to the

Patna High Court CR. MISC. No.11900 of 2019(2) dt.27-02-2019 2/2 petitioners, rather they should surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

With the above observation, this application is dismissed.
