The petitioner seeks regular bail in connection with Murliganj P.S. Case No. 39 of 2015, registered for offences punishable under Sections 147, 148, 149, 323, 307, 379 and 504 of the Indian Penal Code and under Section 27 of the Arms Act. Allegation against the petitioner that he took away the golden chain of the informant while other co-accused assaulted him.
It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case on the backdrop of land dispute and no occurrence as alleged in the F.I.R has ever taken place. However, there is no allegation against the petitioner
Patna High Court Cr.Misc. No.24610 of 2017 (2) dt.29-05-2017 2/2 either of firing or of assaulting the informant. Petitioner has been languishing in judicial custody since 22.03.2017 and other coaccused having similar allegation, has already been granted bail by this Court vide order dated 15.07.2016, passed in Criminal Miscellaneous No. 28016 of 2016 Learned counsel for the State opposed the prayer for bail. Considering the fact and circumstances of the case, nature of allegation and also that other similarly situated coaccused, has already been granted bail by this Court, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Murliganj P.S. Case No. 39 of 2015.
