JUSTICE SUDHIR SINGH ORAL ORDER 25-04-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case registered under Sections 420, 406, 467, 468 and 120(B) of the Indian Penal Code.
The allegation against the petitioners is of cheating and taken the money of the informant and closed the office and absconded away as well.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. The petitioners have falsely been implicated in the present case. There is no evidence to show the implication of the petitioners in the present case. It is further submitted that the petitioners are ready to deposit an
Patna High Court Cr.Misc. No.11123 of 2016 (2) dt.25-04-2016 2/2 amount of Rs. 20,000/- (twenty thousand) jointly in the court below, which shall be subject to final disposal of the case. On behalf of the State, it is submitted that the petitioners are named in the FIR.
Considering the aforesaid facts, the petitioners are directed to deposit an amount of Rs. 20,000/- (twenty thousand) jointly in the court below, which shall be subject to final disposal of the case.
Let the above named petitioners, in the event of their arrest/surrender in the court below within a period of eight weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/( ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj in Kishanganj P.S.Case No. 399 of 2012,subject to the conditions as laid down u/s 438(2) Cr.P.C.
