Petitioners are apprehending arrest in connection with Jaynagar P.S. Case No. 391 of 2019 for the offence under sections 341, 323, 307, 504/34 of the Indian Penal Code. Learned counsel for the petitioners submits that petitioners have no criminal antecedent.

Learned counsel submits that allegation of assault is against petitioner no.1. There is omnibus general allegation

Patna High Court CR. MISC. No.12012 of 2020(2) dt.05-03-2020 2/2 against petitioner nos. 2 to 5.

Considering the aforesaid, the Court is inclined to grant anticipatory bail to the petitioner nos. 2 to 5 let the petitioner nos. 2 to 5 in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Madhubani, in connection with Jaynagar P.S. Case No. 391 of 2019 subject to the condition as laid down under section 438(2) of the Cr.P.C. So far as petitioner no.1 is concerned, the Court is not inclined to grant bail. In the event, the petitioner no.1 surrenders before the court below and prays for regular bail, the court below shall consider regular bail of petitioner no.1 without being prejudiced by this order and dispose of the application for regular bail on the same day.
