2. Petitioner apprehends arrest in a case registered for the offence punishable under section s 304, 37, 338 and 307 of the I. P . C and 25(a) of Arms Act.

3. As per the prosecution case, this petitioner is alleged to have opened fire from his rifle , as a result of which two persons sustained injuries in which one of them died.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case only on the basis of suspicion. The petitioner never participated in the alleged marriage, and there is no eyewitness to the alleged occurrence. Petitioner claims clean antecedent.

Learned counsel for the state opposes the prayer for bail and submits that there is a specific allegation against this petitioner: that he fired from his rifle, due to which two persons sustained injuries in which one of them died. He further submits that during the investigation, it was found that the petitioner was armed with a rifle, and the same was also identified in the CCTV footage and from other sources.

6. Considering the nature of accusation and gravity of offence , prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Koushik/- U T
