JUSTICE SANDEEP KUMAR ORAL ORDER 21-12-2021 At the very outset, learned counsel for the petitioner seeks permission to withdraw the present anticipatory bail application as against petitioner No. 2 (Jahirun Nisha) who is mother-in-law of the deceased.
Permitted to be withdrawn.
It is, thus, dismissed as withdrawn as against petitioner No. 2.
Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection
Patna High Court CR. MISC. No.23532 of 2021(2) dt.21-12-2021 2/2 with Kodhobari P.S. Case No. 25/2020 registered for the offences punishable under Sections 304(B)/323/504/506/120(B) /34 of the Indian Penal Code.
Considering the relationship of these petitioners with the deceased, the present anticipatory bail application is allowed.
Accordingly, let the petitioners above named (except petitioner No. 2 (Jahirun Nisha) be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kishanganj, in connection with Kodhobari P.S. Case No. 25/2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
