JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 272 and 273 of the Indian Penal Code and section 47(a) of the Excise Act. 350 liters of spirit was recovered from the orchard behind the courtyard of the petitioner.
It is submitted by the learned counsel for the petitioner that the recovery cannot be treated from the possession of the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Isuapur P.S. Case No. 140 of 2014 pending in the
Patna High Court Cr.Misc. No.10019 of 2015 (2) dt.11-03-2015 2/2 court of learned JM Ist Class, Saran at Chapra. This application is disposed of with the aforesaid observation/direction.
