The petitioners apprehend their arrest bail in a case under Section 304B and other sections of the Indian Penal Code. The petitioners are father-in-law and mother-in-law of Gita Devi. The father of the deceased stated that Gita Devi was married to Yogendra Yadav in the month of May, 2010 but her husband and in-laws started subjecting her to physical and mental torture due to non-fulfillment of demand of dowry. She also gave birth to a female child in the month of September, 2014 but her husband and in-laws killed her and cremated her dead body. It is submitted that no specific allegation is made against the petitioners. Gita Devi died due to illness. No complaint was ever
Patna High Court Cr.Misc. No.16067 of 2015 (2) dt.28-04-2015 2/2 made about the demand of dowry and torture before the death of Gita Devi.
Considering the facts aforesaid and the fact that the petitioners are father-in-law and mother-in-law of the deceased, the above named petitioners, in the event of their arrest or surrender in the court below within four weeks from today, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Miss. Akanksha Kashyap, J.M. 1st Class, Gaya in Khijarsarai P.S. Case No. 241 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Prabhat Kumar Jha, J) Dilip/- U T
